The language of contract is German.

 

1. Conclusion of contract

All descriptions of goods and prices, addressed on BIKE-MAILORDER.DE, represent a non-binding offer to the buyer to purchase products from us. The customer places a binding offer by clicking on the link marked »confirm order«. After entering the necessary information for the processing of contracts and the selection of payment and delivery method, the customer places a binding offer by clicking on the link marked »confirm order«. Up to this point you will have the opportunity to correct type errors or cancel your order.

Upon submission of the quotation the customer will receive an automatically generated email, which confirms the receipt of the quotation on the server of BIKE-MAILORDER.DE and will inform the customer of their revocation right in text form. Expressively, this confirmation email does not represent an acceptance of the customer's quotation by BIKE-MAILORDER.DE. The contract of delivery of goods will be achieved by the delivery of the order to the customer by BIKE-MAILORDER.DE.

You will receive all terms of contract, the content of your order and our General Business Terms upon delivery of goods. In addition, you may also print out the page, which you are using for your order, for your records. We save the text of the contract after the conclusion of contract. The text of contract will not be available to you on the Internet. Should you lose your records regarding your order, please contact us via email. fax or telephone. We will send you a copy of your order information.

 

2. Shipping costs

The shipping costs within Germany are EUR 3.90 with an order value up to EUR 49.90. BIKE-MAILORDER.DE will ship free of cost with an order value starting at EUR 50.00. This only applies to shipments within Germany. In case of a decrease of the order value below EUR 50.00 by returning goods, the resulting postage fees will be due in arrears. Independent of the order value additional costs will apply when choosing the COD service. Furthermore, EUR2.00 repatriation fee (DHL fee) will apply. Costs for international shipping are determined by the country of destination and are available at a separate menu option. Regular return costs are your responsibility if the goods supplied correspond with those ordered and if the price of the items to be returned does not exceed a value of EUR40.00 or, in the case of a more expensive item, you have not fulfilled your part of the agreement or made a contractually agreed part payment at the point of the revocation. Otherwise the return of the merchandise is free for you. Merchandise, not consignable by parcel post, will be picked up from the customer.

 

3. Methods of Payment

1. Payment in advance:
BIKE-MAILORDER.DE will deliver your order after receiving complete payment to following bank account. Please state your order number when making payments.

2. PayPal:
PayPal is an external payment service. BIKE-MAILORDER.DE will deliver your order after receiving confirmation of complete payment. PayPal works fast and secure. You'll find more information here: https://www.paypal-deutschland.de/privatkunden/Paypal payments are integrated in our online shop BIKE-MAILORDER.DE but will be processed on the secure PayPal servers. Our PayPal account is: paypal [at] bike-mailorder [dot] de.

3. Credit Card:
BIKE-MAILORDER.DE accepts payments made with your own VISA and MASTER CARD. Your data will be transmitted with SSL-encryption. BIKE-MAILORDER.DE will deliver your order after successful authorization of complete payment on the card. We will charge your credit card upon delivery. The delivery will only be made to the registered address on the credit card's country of origin.

4. Cash on delivery (COD):
COD shipments are only possible within Germany. COD payments can only be made with an order value starting at 20.00 EUR. Independent of the order value additional costs of EUR4.00 COD fee, as well as EUR2.00 repatriation fee (DHL fee) will apply.

 

4. Right to Revocation

Revocation Policy for Consumers 

The following right to revocation exists for consumers only.

Revocation Policy 

You can revoke your contractual declaration by writing within 100 days without giving reasons (e.g. letter, fax, E-Mail) or - if the goods have been ceded into your possession before expiry of the term - by returning such goods.

The withdrawal period starts when this information is received in writing, but not before the goods are received by the recipient (where similar goods are delivered on a recurring basis, then not before receipt of the first part delivery), nor before we have fulfilled our obligations to provide information as defined in Article 246 § 2 in conjunction with § 1 (1) and (2) of the Introductory Act to the Civil Code ("EGBGB") as well as our duties under § 312e (1) sentence 1 of the BGB in conjunction with Article 246 § 3 EGBGB.

The right of revocation does not apply inter alia to contracts for the delivery of audio or video recordings or software, in cases where the delivered data carriers have been unsealed by the user.

Consequences of revocation 

In the case of an effective revocation, the mutually received benefits and, if so, derived profits (e.g. interest) are to be returned.

If you are unable to return rendered services, as well as benefits (e.g. benefits from use), either in total or partially or in a deteriorated condition, you are required to offer a compensation of equal value.

You only have to render compensation for deterioration of merchandise and derived benefits, if benefits and deterioration are the result of use and handling beyond the purpose of inspection of the properties and functioning of the merchandise. The 'inspection of the properties and functioning' is understood as the testing and trial of the respective merchandise, just as it is possible and common at the store.

Merchandise, consignable by parcel post, is to be shipped at our risk. Regular return costs are your responsibility if the goods supplied correspond with those ordered and if the price of the items to be returned does not exceed a value of EUR40.00 or, in the case of a more expensive item, you have not fulfilled your part of the agreement or made a contractually agreed part payment at the point of the revocation. Otherwise the return of the merchandise is free for you. Merchandise, not consignable by parcel post, will be picked up from the customer. Obligations for reimbursement of payments must be fulfilled within 30 days. Your term starts on submission of the declaration of revocation or the merchandise, and for us upon receipt thereof.
